Terms of Service

1. Agreement
These Terms govern your use of Gallmo ("the Service") — photo hosting and publishing of interactive 3D galleries. The Service is offered only to adults who reside in the United States. By selecting the account confirmation and creating or signing into an account, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Service.
We record the date, method, and version of each acceptance; you can see the current acceptance in Account settings.
2. Your account
You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account. You may sign in with a password or a linked social identity; you can set or change a password and revoke sessions at any time from Account settings. You must be at least 18 years old and a resident of the United States to create or use an account.
3. Subscriptions & billing
Publishing and uploads are enabled per gallery through a subscription for that gallery. Prices and term length are shown before you subscribe. At checkout you can choose whether the subscription renews automatically; you can turn auto-renew on or off before the end of the paid term. Turning it off schedules cancellation at the end of that term, and the gallery remains available until then. Payments are processed by Stripe; we do not store card numbers.
Your authorization. Before payment, we show the exact price, billing interval, media allowance, renewal choice, cancellation policy, and media-retention consequence. Auto-renew is off unless you select it. You must separately authorize the displayed purchase, and we keep an immutable record of that disclosure and choice. We email a confirmation after purchase. If you select auto-renew, we also email a reminder before renewal with the amount, date, and a direct online cancellation link.
No proration. We do not provide prorated refunds, credits, or partial-term adjustments when you turn off auto-renew, cancel, or change a plan. Your paid access continues through the end of the current term. Except where required by law, fees are non-refundable.
Promotion codes. A promotion code, if offered, applies only as shown at checkout and only to the first charge of the subscription. Codes have their own eligibility, expiry, and redemption limits; they have no cash value, cannot be applied retroactively, and do not extend a paid term or change the Service limits. We may deactivate a code that is expired, exhausted, misused, or published in error.
Etsy packages. If you purchased a Gallmo package through Etsy, your package is prepaid and does not automatically renew through Gallmo: the $39 package includes up to 50 photos for 6 months, and the $79 package includes up to 80 photos for 2 years. The included term starts when the gallery is delivered. Any renewal is a separate purchase disclosed at the time of renewal.
Failed payments. If a renewal payment fails, the gallery keeps publishing and accepting uploads for a 3-day grace period from the first failed charge while we retry it. If payment has not succeeded by the end of the grace period, the gallery's public link stops serving and uploads are disabled until payment is resolved or the subscription is canceled — this does not, by itself, start the deletion described below.
Cancellation and photo retention. When a gallery's subscription is canceled — by you, or because a failed payment was never resolved — its public link stops serving immediately and uploads are disabled. Its photos and videos are kept for 14 days from cancellation: resubscribing during that window fully restores the gallery with nothing lost. After 14 days, all photos and videos in that gallery are permanently deleted from our servers and cannot be recovered — keep your own copies. The gallery itself (its name, description, and settings) is not deleted and remains in your account; only its media is removed. Deleting your account or a gallery directly, as described in Section 8, deletes its content immediately rather than after 14 days.
4. Your content
You retain all rights to the photos you upload. You grant us a limited, worldwide, royalty-free license to store, reproduce, resize, transcode, create thumbnails or poster frames, screen for prohibited content, cache, display, and transmit your content solely to operate and secure the Service — including using our service providers and serving it to anyone you share a publish link with. We claim no ownership and will not sell your photos or use them for advertising or to train machine-learning models.
5. Publishing, sharing & other people in your photos
Publishing a gallery generates an unguessable link. By default, anyone with that link can view the gallery while its subscription is active. You may add a separate gallery password, in which case a viewer needs both the link and password. Password protection is not identity verification, and a recipient can forward either credential, so treat the link and any gallery password as secrets. You can change or remove the password, or unpublish at any time to revoke public access.
You are responsible for what you publish and for having the rights to every photo and video you upload. Family photos usually show other people: where you publish images of identifiable people, you are responsible for having a proper basis to do so under the law that applies to you, and for honouring any request they make to you to take an image down. In data-protection terms you are the controller of what you choose to publish and we are your processor for storing and serving it. If someone contacts us directly about an image you published, we may pass the request on to you or, where the law requires it, remove the content.
6. Acceptable use
You may not use the Service to store or distribute content that is unlawful, infringing, sexually exploitative of minors, harassing, or malicious (including malware); attempt to access other users' data; probe, disable, or overload the Service; or resell it without permission. We may suspend or terminate accounts that violate these rules.
Every upload is screened automatically before it is stored. When you add a photo or video — whether you upload it directly or import it from Google Photos — it is checked by an automated system that scores it for nudity, sexually explicit content, other adult ("NSFW") content, and graphic violence. If a score exceeds our threshold the file is rejected and never stored. To perform the check, we send a resized analysis copy of each photo, or sampled video frames, over HTTPS to the moderation provider named in our Service Providers register, or process it in our private moderation service. No Gallmo employee sees it as part of this automated step, and it produces no profile of you.
Automated screening is imperfect in both directions. It can wrongly reject an innocent photo — swimwear, breastfeeding, art, and medical images are known to trip these models — and it will not catch everything. If a legitimate photo is rejected, contact us at legal@gallmo.app. If the screening system is unavailable, uploads are refused rather than accepted unchecked, so uploading may occasionally be temporarily unavailable.
Separately, images served from published galleries are screened against known hash lists of child sexual abuse material by our delivery provider. Where a match is reported to us we will block the content, and we will report it and cooperate with the authorities as the law requires.
Reported content and enforcement. If content is reported to us, or an automated check flags an account, a member of our team may review the specific media concerned in order to act on it — see the Privacy Policy, Section 4c. We may remove content and suspend or terminate accounts under this Section. Every such action is recorded in an internal audit log.
Operations assistant. We may use an internal automated operations assistant (Hermes) for routine account and order workflows. Hermes receives account and workflow metadata only; it is not given image or video bytes, thumbnails, or private gallery media. Hermes does not override these Terms or make final decisions about refunds, legal notices, account suspension, or content enforcement; those matters are escalated for human review.
6a. Support — what we do and do not provide
Gallmo is a self-service product, operated by a very small team. Please read this section carefully, because it sets your expectations for help:
- Everything needed to run your galleries is built into the app: creating and publishing galleries, uploading and organizing media, resetting your password, downloading all of your data, and deleting your account. These are designed to be used without our involvement, and they work at any hour.
- We provide no live support: no telephone support, no live chat, no guaranteed response time, and no named account contact. We do not commit to any service level, uptime target, or support hours.
- We may offer help by email or an automated assistant as a courtesy. Any such help is provided on a best-effort basis, may be given wholly or partly by automated means, and may be changed, limited, or withdrawn at any time without notice. Nothing in this section creates an obligation for a human to respond to a general support enquiry.
- Where an automated assistant answers you, its output may be inaccurate or incomplete. It does not make decisions about your account, does not bind us, and its answers do not vary or override these Terms.
Two things we do commit to, because they matter. First, we will deal with requests about your own data — getting a copy, correcting it, deleting it — and most of those you can do yourself at once, without contacting us (Privacy Policy, Section 6). Second, we will act on valid legal notices, including copyright takedowns (Section 7) and reports of unlawful content. Send these to legal@gallmo.app and privacy@gallmo.app respectively; those inboxes are monitored for that purpose. Nothing in this section limits any rights you have as a consumer under the law where you live, or our obligation to supply the Service you paid for.
Keep your own copies. Because there is no guaranteed support channel to recover lost work through, you should keep original copies of every photo and video you upload. Gallmo is a way to present and share your photos — it is not a backup service, and should not be your only copy.
7. Copyright complaints
If you believe content on the Service infringes your copyright, send a takedown notice to legal@gallmo.app including: the work claimed to be infringed, the URL of the infringing material, your contact details, a good-faith statement, and a declaration under penalty of perjury that you are authorized to act. We will remove content in response to valid notices and may terminate repeat infringers.
8. Termination
You may delete your account at any time from Account settings; this permanently deletes your galleries and photos. We may suspend or terminate the Service or your account for breach of these Terms, with notice where practicable.
9. Disclaimers & liability
The Service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. We do not warrant that it will be uninterrupted or error-free.
To the maximum extent permitted by law, our aggregate liability for any claim arising out of the Service is limited to the amounts you paid us in the twelve months preceding the claim, and we are not liable for indirect, incidental, or consequential damages, or for loss of data.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited — including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any liability arising from our failure to supply the Service with reasonable care and skill. If you are a consumer, you always keep the rights the law where you live gives you, and nothing here overrides them.
9a. Governing law & disputes
These Terms are governed by the laws of the State of Colorado, and the courts of the State of Colorado have jurisdiction. This does not waive any non-waivable consumer protection provided by the U.S. state where you reside.
10. Changes
We may update these Terms. Material changes will be announced in the app or by email at least 14 days before taking effect and will require affirmative acceptance when you next sign in. We do not relabel an earlier acceptance as consent to a later version. If you do not accept a change, you may cancel and delete your account.
